Severed estates
When a prior owner sold the surface and kept the minerals, the estates became severed. Those two estates can then be sold, inherited, and taxed independently for generations.
The dominant estate
In most Southwest states the mineral estate is dominant, meaning it carries a reasonable right to use the surface to develop the minerals. Surface use agreements and state rules shape how that plays out in practice, and Colorado's populated corridors are where it gets most attention.
Finding out what you own
A title commitment from your purchase, or a deed reviewed at the county level, will normally show whether minerals were reserved. Buying rural acreage without minerals is common and often goes unnoticed until a leasing letter arrives.
