Mineral Rights and Probate

Minerals sit in the state where the land is, not the state where the owner lived. That single fact causes most probate surprises.

Ancillary proceedings

When someone dies in one state owning minerals in another, an additional filing in the mineral state is often needed before title is clear. A California resident with Texas minerals is a routine example.

Suspended payments

Operators frequently place royalties in suspense after an owner dies. The money is generally held, not lost, and is released once ownership is documented and a new division order is processed.

Multiple heirs

When several heirs each hold a small piece, coordinating a single review is usually simpler than each person acting alone. Tell us how many heirs are involved so nothing is promised that requires signatures nobody has.

Not legal advice
